Heard learned counsel for the parties and perused the record. 2. This writ petition has been filed seeking following relief :- "to issue a writ, order or direction in the nature of Mandamus directing the respondents to initiate the proceedings under Section 67-A of U.P. Revenue Code, to remove the illegal construction/encroachment from Talab of Gata No.172 Village Jiyanpur, Tehsil Aurai, District Sant Ravidas Nagarr, Bhadohi within specific time frame as this Hon'ble Court;" 3. A preliminary objection has been raised by learned Standing Counsel that for the same relief, petitioner has already approached this Court by way of filing Writ C No.41311 of 2023. The said writ petition has been disposed of vide order dated 1.12.2023. 4. In view of the Rule 7 of Chapter XXII of the High Court Rules, 1952, second writ petition is not maintainable for the same cause of action. 5. Accordingly, the writ petition is dismissed.
