Heard the parties. The petitioner has been made accused in connection with Cyber P.S. Case No. 179 of 2024, for the offences registered under Sections 318(4)/ 319(2)/336(3)/338/340(2)/61 of the B.N.S. and Sections 66B/66C/66D of the I.T. Act, pending in the court of learned A.J.C.-II-cum-Spl. Judge, Cyber Crime, Ranchi. It appears that accused persons had started a WhatsApp group in the name of N-Wisdom in stocks AQR170. Several persons invested in stocks through his WhatsApp group. It appears that the informant had also invested Rs.39,31,910/- online through his WhatsApp group. The accused persons embezzled the entire amount. It was submitted that about Rs. 6.00 lakhs were transferred to the account of the petitioner. It was further submitted that petitioner has become victim of circumstance as he was allured by the main accused persons to let him use his account. It was further submitted that after the money was transferred to the account of the petitioner, the main accused persons withdrew the amount. Mr. Priyanshu, learned counsel for the informant has vehemently opposed the prayer for bail. Report regarding the stage of trial earlier called for, has been received. It appears that though the charge has been framed in this case, but no witness has been examined as yet. -2-
It appears that petitioner is in custody for about 13 months. It further appears that petitioner was a money mule and he has become victim of his greed. In view of the aforesaid facts, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned A.J.C.-II-cum-Spl.
