Neutral Citation No. - 2025:AHC:86611-DB Chief Justice's Court Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 1318 of 2025 Petitioner :- Omveer Singh Respondent :- State of U.P. and 3 others Counsel for Petitioner :- Dev Kaushik, Sanjay Shukla Counsel for Respondent :- S.C., Rajiv Singh Hon'ble Arun Bhansali,Chief Justice Hon'ble Kshitij Shailendra,J.
1. This petition purportedly in public interest has been filed seeking to stop illegal extraction of ground water by respondent no. 4 at Yamuna Expressway, Noida, District Gautam Buddh Nagar.
2. Submissions have been made that respondent no. 4 is a private builder and is illegally extracting ground water in and around the area in question which has allegedly been decreasing the ground water level in the area and its adjoining villages.
3. Based on the address of the petitioner and that of the location of respondent no. 4, when a query was made pertaining to the distance, learned counsel for the petitioner submitted that the distance is sizeable. Another query was made as to whether the respondent no. 4 is the only builder who is extracting water in the area from the petitioner's residence to the area in question,
submissions have been made that there may be others also and qua few other petitions have been filed.
4. A bare look at the representation made by the petitioner reveals that the same is wholly cursory in few lines only making allegations against respondent no. 4 and seeking an order against
it. Filing of petitions in public interest, based on cursory representations and without undertaking any research and/or making its nature that of public interest, only by way of targeting an individual, cannot be countenanced.
5. Petition apparently has no substance, which has been filed targeting respondent no. 4, the same is, therefore, dismissed.
