Let the affidavit of service filed by the petitioner be taken on record. The petitioner claims ownership in respect of Plot No. 2086 under Amlajora Gram Panchayat, J.L. No. 64, Police Station – Kansa, District – Paschim Medinipur. It is the grievance of the petitioner that respondent nos. 6 to 10, who are his neighbours and own properties situated in front of the petitioner’s plot, have erected a barbed-wire fence enclosing an “al poth” (a small strip of land). The said “al poth” allegedly runs through the petitioner’s property connecting it to the main road, and the fencing has obstructed his free ingress to and egress from his residential house. It is submitted that the said “al poth” is a property belonging to the Panchayat, and despite a representation being made to the Pradhan of 2 Amlajora Gram Panchayat, no steps have been taken till date. Respondent nos. 6 to 10 are not represented. There is no justification for keeping this writ petition pending. Accordingly, the writ petition is disposed of with a direction upon the Amlajora Gram Panchayat to consider the representation of the petitioner dated January 15, 2025, appearing at page 44 of the writ petition. The concerned Gram Panchayat shall afford an opportunity of hearing to the petitioner as well as to respondent nos. 6 to 10, and upon hearing the parties, shall pass a reasoned order in accordance with law and communicate the same to the parties. The entire exercise shall be completed within a period of two months from the date of communication of this order. Accordingly, WPA 2632 of 2025 stands disposed of. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities. ( Kausik Chanda, J. )
