1. This is an ofÏce reference.
2. This Court, vide order dated 16.07.2024, passed in MCRC No. 3335 of 2024, while rejecting the bail to the applicant, namely, Ramkumar, had expressed its trust that the trial Court should make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months, if there was no legal impediment.
3. The learned Additional Sessions Judge, Chirmiri, District-Koriya (Now Manendragarh-Chirmiri-Bharatpur), vide his request letter dated KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 13.01.2025 has requested for grant of three months time for concluding the trial.
4. It transpires from perusal of the PUD, that in this case, the crucial witness, Chander Singh, has passed away. His wife, Mangli Bai and another important eyewitness, were summoned to testify on multiple dates via summons, bailable warrants and arrest warrants. However, she couldn't be located as she no longer resides at the given address and her current whereabouts are unknown. In this case, apart from Mangli Bai's statement, the prosecution intends to examine investigating ofÏcer- O.P. Dubey and the competent Court has made efforts to expedite the trial by issuing arrest warrants for Mangli Bai and O.P. Dubey through the Superintendent of Police, asking them to present themselves for testimony on the specified date without handcuffs. Hence, it is likely to take some time for concluding the trial therefore, he prays for grant of further three months time for concluding the same.
5. The request appears to be reasonable. The concerned trial Court is
directed to conclude the trial as early as possible, preferably within a further period of three months from today.
6. Accordingly, this CRMP stands disposed off with the aforesaid direction.
7. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
