Dipankar Ghosh, ….for the State. Affidavit of service filed by the petitioners and report submitted by the State are taken on record. Learned counsel for the petitioners submits that the petitioners have been ousted from their residential houses by local goons due to political rivalry and are not able to return to their homes. It appears from the report submitted by the State that ten criminal proceedings have been registered against local miscreants and five proceedings against the petitioners. Learned counsel for the State submits, on instructions, that the petitioners have returned to their respective homes and are staying there peacefully. In view of the above, this Court is inclined to hold that in the event the petitioners have not been able to return to their respective homes till date, they shall approach the Officer in charge, Canning Police Station and inform the police authority when they intend to return to their homes. The police authority shall render sufficient and adequate assistance to the petitioners in order to enable them to return to their respective houses peacefully 2 and continue to reside therein. The police authority shall keep strict vigil over the area which shall include regular patrolling so that no untoward incident takes place and there is no breach of peace and tranquility in the area. The police authority shall also render necessary police assistance as and when required and shall ensure that they are able to reside in their respective homes peacefully. With the aforesaid observation and directions, the writ petition is disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted.
