BEFORE HONOURABLE MR. JUSTICE PARTHIVJYOTI SAIKIA ORDER Date : 11.03.2025 Heard Mr.S C Biswas, the learned counsel appearing for the petitioner. Also heard Mr. D.P. Goswami, the learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 483 of the BNSS, 2023, whereby the petitioner, Munu Baidya @ Pushki has prayed for releasing him on bail, after he was arrested in connection with Rangapara P.S. Case No. 110/2024. 3. The informant has alleged in the FIR that the present petitioner had poured kerosene oil
Page No.# 2/2 on her husband and set him on fire. Her husband sustained burn injuries and had to be shifted to different hospital and subsequently he succumbed to the burn injuries. 4. The post-mortem report, which has been called for, has not been received. 5. The case diary reveals that the deceased went to the shop of the present petitioner, where they had a quarrel. The husband of the informant threatened the petitioner by showing a burnt match stick. Suddenly, the match stick burnt him. The present petitioner tried to save his life. For that matter, he also sustained severe injuries. 6. I have considered the submissions made by the learned counsel of both sides in the light of the materials available in the case diary. 7. The petitioner has already spent 81 days in judicial custody. 8. This Court is of the opinion that the petitioner no longer deserves to be detained in custody. Therefore, the bail application of the petitioner is allowed. 9. It is hereby directed that the petitioner, namely, Munu Baidya @ Pushki, who was arrested in connection with Rangapara P.S. Case No. 110/2024, shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Sonitpur, Tezpur. With the aforesaid direction, the bail application stands disposed of. The CD shall be returned.
