Challenge in the present petition is to the order dated 26.04.2024 whereby the claim of the petitioner for appointment as Airmen has been rejected on the ground that the old scheme has been discontinued.
Learned counsel appearing on behalf of the respondent(s)-UOI refers to the judgment dated 27.02.2023 passed by the High Court of Delhi in W.P.(C) No.11011/2022 titled as ‘Harsh Ajay Singh Vs. Union of India and others’ and other connected matters and upheld by the Hon’ble Supreme Court vide order dated 10.04.2023 passed in SLP(C) No.5203 of 2023 titled as ‘Gopal Krishn and others Vs. Union of India and others’ to contend that individuals do not have a vested right to gain employment merely because they have been waiting for issuance of appointment letters under a previous recruitment process.

Learned Counsel for the petitioner is not in a position to controvert the abovesaid judgments and seeks withdrawal of the present writ petition. Present petition is accordingly dismissed as withdrawn. Liberty is, however, granted to the counsel for the petitioner to seek revival of the present petition, in case, it is found that the aforesaid
judgment is not applicable to the facts of present case.
