Heard Sri Anand Kumar Pandey, learned counsel for the petitioner and Sri B.M.Shukla, learned Standing Counsel. 2. This is the second round of litigation. 3.In the first round, petitioner has approached this Court by way of filing a Writ Petition No.25840 of 2018, Neutral Citation No.2024:AHC:140843 which was disposed of vide order dated 31.8.2024 with an observation and direction to consider the claim of the petitioner for payment of salary and impugned order therein dated 24.5.2017 was set-aside. 4.Learned counsel for the petitioner submits that subsequently a fresh order was passed by respondent no.3 on 25.12.2024, whereby claim of petitioner for payment of salary was passed 5. Learned counsel for the petitioner further submits that despite aforesaid order, salary was not released and by subsequent order dated 7.2.2025, District Basic Education Officer, Ballia has sought guidance from Director of Basic Education. 6. Learned counsel for the petitioner further submits that there was no requirement of such guidance. 7. Learned Standing Counsel submits that since a communication is made by the District Basic Education Officer, Ballia and if it is still pending before Director of Basic Education, it will be communicated accordingly. 8. In the aforesaid circumstances, since the matter is still seized with the concerned respondent, therefore, this writ petition is disposed of with a direction that in case the District Basic Education Officer, Ballia does not communicate the order in pursuance of letter dated 7.2.2025, said respondent will follow the order dated 25.12.2024 passed by Assistant Director of Education, Azamgarh and in case still there is a legal impediment to follow the said order he will communicate it to the petitioner.
