Though the application under Section 528 BNSS has been preferred by the applicants for quashing the proceeding of complaint case no. 4400 of 2024 (Shailendra Singh vs. Chandra Shekhar alias Monu and Ors) U/s 4 of D.P. Act, P.S. Bewar District Mainpuri pending in the court of Judicial Magistrate, court no.2, Mainpuri as well as the impugned summoning order dated 30.08.2024 passed by Judicial Magistrate, Court no. 2 Mainpuri but the learned counsel for the applicants has confines his relief only for a direction for consideration of the bail in view of the judgment in the case of Satender Kumar Antil Vs. Central Bureau of Investigation, (2022) 10 SCC 51. 3. Learned A.G.A. has no objection to the same. 4. Considering the submissions raised at the Bar, the application stands disposed of while observing that in case appropriate proceeding in the form of bail application is preferred before the court below by 13.06.2025, then the same shall be decided by the court below with most expedition, strictly in accordance with law preferably within a period of 45 days of the land keeping in view the judgment in the case of Satender Kumar Antil (Supra). 5. Till the bail application is decided, no coercive action is taken against the applicants in complaint case no. 4400 of 2024 (Shailendra Singh vs. Chandra Shekhar alias Monu and Ors) U/s 4 of D.P. Act, P.S.
