The present petition is filed under Section 11 of the Arbitration and Conciliation Act, 1996 (for short ‘the Act’) for appointment of an arbitrator. 2. The parties to the lis entered into a contract whereby the respondent issued a Letter of Intent dated 25.02.2021 followed by a sub-contract dated 01.03.2021 for stone works-mock-up for development/redevelopment of Central Vista Project at New Delhi for a contract value of ₹2,44,07,045/- excluding GST. The petitioner carried out the work and the respondent issued work orders and amendments from time to time. The contract contains an arbitration clause 19.1 for resolution of disputes. Disputes arose due to non-payment of dues of the petitioner and despite invocation of the arbitration the respondent failed to appoint an arbitrator giving rise to the present petition. Accordingly, the petition is allowed by appointing Mr. Tushar Mehra, Advocate (Mobile No.: 9717471680) as the sole arbitrator with the consent of the parties for adjudication of the disputes which have arisen between the parties. 5. The fees of the learned Arbitrator will be governed by Schedule IV of the Act. Before entering upon reference, the learned Arbitrator will comply with Section 12 of the Act. 6. It is made clear that since this Court has not expressed any opinion on the merits of the rival claims of the parties, it will be open for the parties to file their respective claims/counter claims before the learned Arbitrator which will be considered in accordance with law. 7.
