JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 06-08-2025 Heard learned counsel for the petitioner and the State. 2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 420, 409/34 of the Indian Penal Code. 3. As per the prosecution case, the petitioner, who was branch manager of a financial institution, namely, Swabhiman Finance Private Limited misappropriated more than 17 lacs of the said financial institution. 4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. petitioner has not received any amount from any client and during investigation, none of the witnesses has supported the prosecution case. Petitioner claims clean Patna High Court CR. MISC. No.49553 of 2025(2) dt.06-08-2025 2/2 antecedent. 5. Learned counsel for the State opposes the prayer for bail. He submits that as per FIR, petitioner, misusing his official position, misappropriated Rs. 17 lacs of the institution in which he was employed as branch manager, as such, he does not deserve privilege of pre-arrest bail. 6.
