Learned counsel for the petitioner would submit that recovery to the tune of Rs. 3,12,594/- was made against the petitioner against which the petitioner has preferred petition bearing W.P.(S) No. 956 of 2012 wherein this Court vide order dated 25.07.2018 has allowed the said petition directing the respondent authorities to refund the entire amount with 9% interest to the petitioner but the said order was not complied with by the respondents, therefore, the petitioner filed contempt petition wherein it has been informed by the respondents that the amount of Rs. 3,12,594/- has already been paid on 04.01.2019 and amount to the tune of Rs. 2,00,554/- towards 9% interest has been paid on
30.09.2021.
3. On the other hand learned counsel for the State would submit that the entire amount has already been paid to the petitioner and nothing remains to be paid to him.
4. This proposition of accepting the amount with interest has not been disputed by the petitioner. No justifiable reasons has been assigned by the petitioner for claiming amount of Rs. 60,805/- and no averments has been made by the petitioner to justify the amount as stated by him.
5. In absence of any foundation to justify the claim of Rs. 60,805/- by the petitioner, no writ can be issued to the respondents at this stage.
