Petitioners are aggrieved by the action of Nagar Nigam, Mathura in interfering with petitioners' land in question. Sri Sahab Tiwari, appearing for the local body points out that a civil suit in respect of the land in question is already pending. It is also submitted that the petitioners in the garb of right over Arazi No.3193 have actually encroached upon the land of Nagar Nigam. From the materials placed on record it transpires that the right of the petitioners over the plot in question is already engaging the attention of the competent civil court. For any other issue with regard to identity/demarcation of the plot the remedy of the petitioners would be to approach the competent revenue authority in terms of Section 24 of the U.P. Revenue Code, 2006. In such a view of the matter and particularly in view of the pendency of civil dispute before the competent civil court, we are not inclined to interfere in the present writ petition, which is, accordingly, consigned to records.
