1. Heard.
2. Learned counsel for the petitioner, after arguing the matter for some time, submits that the petitioner has not availed the alternative remedy available under law and has not approached the concerned Collector as well as the Commissioner. At this stage, learned counsel for the petitioner seeks permission of this Court to withdraw the petition with liberty to file appropriate proceedings before the concerned Collector and the Commissioner. It is further submitted that the authorities concerned may be directed to consider the aspect of limitation also, inasmuch as the petitioner had approached this Court directly on 06.11.2021 and the matter remained pending before this Court since then.
3. Considering the aforesaid submissions, the petitioner is permitted to withdraw the petition with liberty to avail the alternative remedy available under law. In the event the petitioner files an appropriate
3 application before the competent authority, the authorities concerned are directed to consider the issue of limitation, keeping in view the period during which the present petition remained pending before this Court.
