Neutral Citation No. - 2025:AHC:88728-DB Court No. - 29 Case :- SPECIAL APPEAL No. - 503 of 2025 Appellant :- Azra Khatoon Respondent :- State Of Up And 5 Others Hon'ble Ashwani Kumar Mishra,J. Hon'ble Praveen Kumar Giri,J.
1. This appeal arises out of an order passed by the learned Single Judge dismissing the appellant's writ.
2. It transpires that appellant was appointed as a teacher in the Madarsa, where she was terminated in the year 1998. A writ petition challenging the termination order was filed in the year 2000, which came to be disposed of on 19.03.2013 holding that the termination itself is in violation of principles of natural justice and the matter was remitted back for fresh consideration.
3. The Inspector examined the claim of the petitioner and rejected her representation vide order dated 09.01.2014. The Inspector has recorded that since the petitioner was living at a distance from the institution, therefore, she was not able to reach on time and was otherwise absent for most of the time. It was for this reason that she was terminated on 26.12.1998. Thereafter, the management has filled up the vacancy by appointing Smt. Zeba Khanam. The appointment of Smt. Zeba Khanam has also been approved way back on 28.02.2002. In the subsequent writ filed in the year 2014, Smt. Zeba Khanam was not impleaded as a party-respondent. It was in this context that when the matter came up before the learned Single Judge in the year 2025, it was not found feasible to consider grant of relief to the writ petitioner, particularly when the selected candidate in place of the writ petitioner was not before the Court. Smt. Zeba Khanam otherwise is working for the last more than 23 years.
4. We also find that the appellant has now superannuated and the total period of working in the institution was around three years.
5. In such circumstances, we do not find any occasion to interfere in the present appeal and is, accordingly, dismissed. Order Date :- 26.5.2025 K.Tiwari Digitally signed by :- KRISHNA KANT TIWARI High Court of Judicature at Allahabad
