Heard Sri Ashutosh Gupta, learned counsel for the petitioner and Ms. Eshita Sand, Advocate holding brief of Ms. Anjali Upadhya, learned counsel for the respondent-Development Authority. 2. The petitioner is the owner of a flat in Omaxe NRI City GH-1, Greater Noida. He has prayed for a writ of mandamus restraining the respondents from conducting election of Resident Welfare Association of Omaxe NRI City, GH-1, Greater Noida on 25.05.2025 as scheduled. 3. The case of the petitioner is that the voter list prepared by the Election Officer is erroneous. The petitioner has filed an objection on 04.05.2025. 4. In relation to his objection, we observe that as per the election program, the provisional voter list was notified for the first time on 08.05.2025 and 12.05.2025 was fixed for disposal of objection and for notifying the final voter list. 5. We do not find any material on record to indicate that any objection was filed by the petitioner after notification of the provisional voter list. 6. The election, as noted above, is scheduled to be held on 25.05.2025. Except the petitioner, who is owner of a single flat, no other person has questioned the election process. 7. In such circumstances, we are not inclined to examine the issue at this stage, as the election process is in progress. We leave it open to the petitioner to raise the issue in appropriate proceedings before appropriate forum after the election is held. 8. The petition stands disposed of, accordingly.
