CRM-M-31776-2024 (O&M) -1- 283 IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH CRM-M-31776-2024 (O&M) Date of decision: 22.09.2025. DALJEET KAUR @ MANJEET KAUR ...Petitioner(s) VERSUS STATE OF HARYANA ...Respondent(s) CORAM : HON'BLE MR. JUSTICE VINOD S. BHARDWAJ Present :- None for the petitioner(s). Mr. Onkar Singh Wahla, Sr. DAG, Haryana. VINOD S. BHARDWAJ, J. (Oral) Seeking quashing of order dated 30.11.2023 declaring the petitioner a proclaimed person passed by the learned Sub Divisional Judicial Magistrate, Tohana, District Fatehabad, in case bearing FIR No.37 dated 27.02.2018 registered under Section(s) 384 and 389 of the Indian Penal Code, 1860 at Police Station Sadar Tohana, District Fatehabad, the instant petition has been filed. 2 There is no representation on behalf of the petitioner. Hence, Ms. Diksha Mahajan, Advocate, (PH-6233-2024; Mobile No.8558872121) RAJ KUMAR ARORA 2025.09.24 10:23 I attest to the accuracy and integrity of this document CRM-M-31776-2024 (O&M) -2- is appointed as legal-aid-counsel to assist this Court on behalf of the petitioner. She has gone through the paper book and submits that the petitioner absented herself during the trial on 08.06.2018 on account of noting the wrong date. She approached this Court by filing CRM-M-46186- 2018 for the grant of anticipatory bail which was allowed vide order dated 17.10.2018. Petitioner continued to appear before the trial Court, however, on account of registration of another FIR, she absented herself from the trial Court whereupon the impugned order dated 30.11.2023 declaring the petitioner a proclaimed person was passed. 3 State counsel, however, on instructions from Sub Inspector Lalit Kumar, contends that the present petition has been rendered infructuous since the petitioner already stands acquitted in the above said FIR vide judgment dated 16.07.2025. He further contends that pursuant to proclamation order dated 30.11.2023, FIR No.07 dated 09.01.2024, under Section 174-A of the Indian Penal Code, 1860, also stands registered against the petitioner in Police Station Sadar Tohana, District Fatehabad. 4 Having heard the learned counsel for the parties and noticing the specific statement of the learned State counsel about the petitioner having been acquitted in the main case after facing the complete trial, I am of the opinion that continuance of the proceedings pursuant to order dated 30.11.2023 culminating into registration of FIR No.07 dated 09.01.2024, under Section 174-A of the Indian Penal Code, 1860, Police Station Sadar Tohana, District Fatehabad, is not likely to advance any substantial interest of justice. 5 Consequently, the present petition is allowed. The order dated RAJ KUMAR ARORA 2025.09.24 10:23 I attest to the accuracy and integrity of this document CRM-M-31776-2024 (O&M) -3- 30.11.2023 declaring the petitioner a proclaimed person along with consequential registration of FIR No.07 dated 09.01.2024, under Section 174-A of the Indian Penal Code, 1860, Police Station Sadar Tohana, District Fatehabad are hereby quashed. 6 A copy of this order be also sent to the High Court Legal Services Committee, for further necessary action.
