Petitioner has filed this writ petitioner under Article 226 of the Constitution of India, seeking following reliefs:- “10.1 That this Hon’ble Court may kindly pleased to call the entire records pertaining to the case of the petitioner. 10.2 That this Hon’ble Court may kindly direct the respondent authorities to take necessary steps regarding enhancement of compensation as per the market value of the diverted land. 10.3 That this Hon’ble Court may kindly pleased to direct the respondent no. 2 to send the objection of the petitioner to the Land Acquisition, Rehabilitation and Resettlement Authority under Section 64 of the Right to Fair Compensation And Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. 10.4 That any other relief which this Hon’ble Court may deem fit and just in the facts and circumstances of the case.” 2. Learned counsel for petitioner submits that land bearing Khasra No. 43/4 measuring 0.57 acres of land situated at Village Pendridih Tehsil Bilha District-Bilaspur, Chhattisgarh was subject matter of land acquisition proceedings which was culminated by passing of an award by Land Acquisition Officer vide order dated 07.06.2017. Petitioner thereafter had submitted an application before Collector seeking enhancement of amount of compensation, however, the Collector has not taken any decision on the application till now. He further submits that letter is also returned to the Land Acquisition Officer who has also not considered the letter/grievances raised by petitioner in the letter submitted before Collector on 02.06.2022 and, therefore, direction be issued to Collector to take decision on pending representation, expeditiously, in accordance with law. 3. Learned counsel for State submits that as petitioner is not pressing this 3 writ petition on merits and is only seeking direction to Collector to take decision on pending representation/application seeking enhancement of amount of compensation he is having no objection. If application is pending consideration, it will be considered in accordance with law. 4. I have heard learned counsel for respective parties and perused the documents enclosed along with this writ petition. 5. On due consideration of submission made by learned counsel for the respective parties, without entering into merits of the claim of petitioner, this writ petition is disposed of at this stage directing respondent no. 2/Collector to consider and take decision on pending representation/application Annexure P-7 dated 02.06.2022, in accordance with law, expeditiously, preferably within a further period of four months from the date of receipt of copy of this Order. 6. However, petitioner will be at liberty to submit fresh representation/application and in case such representation is submitted concerned authority shall consider fresh representation along with application dated 02.06.2022, in accordance with law, as directed above if not already decided. 7.
