W.P.(C)No.12467 of 2025 :2: 2025:KER:26279 J U D G M E N T Dated this the 27th day of March, 2025 The petitioner is the Stage Carriage Operator conducting service on the route Thengode-Kothamangalam via Oonukal, Nellimattam, Kuthukuzhy on the strength of Regular Permit issued in respect of Stage Carriage bearing No.KL-40A-
4149. The petitioner has been operating on the route in question with a set of timings issued by the respondent on
15.03.2018. 2. The circumstances which were in existence as on 15.03.2018 have changed drastically due to introduction of new services, the timings and permits of the existing services being revised and varied etc. All these factors constitute a
W.P.(C)No.12467 of 2025 :3: 2025:KER:26279 ground for revision of timings as held by a Division Bench of this Court in Krishnankutty v. John [1992 (2) KLT 883]. 3. In the said circumstances, the petitioner has submitted Ext.P3 request for revision of timings. However, despite receipt of Ext.P3 and repeated requests made by the petitioner, the respondent has not taken any step to consider the request and to make necessary revision in the timings of the petitioner's service. 4. Heard. 5. The petitioner submits that Ext.P3 is the application for revision of timing. The writ petition is filed by the petitioner seeking direction to the respondent to consider the application for revision of timings. 6. It is evident that Ext.P3 is an application for revision of timing which has statutory support. Therefore, it is necessary that the competent authority considers Ext.P3 in

The writ petition is therefore disposed of directing the respondent-Secretary, Regional Transport Authority to consider Ext.P3 application submitted by the petitioner and take appropriate decision thereon, within a period of one month in accordance with law and after giving opportunity of hearing to the affected parties.
