Neutral Citation No. - 2025:AHC:87977 Court No. - 5 Case :- WRIT - A No. - 7345 of 2025 Petitioner :- Smt. Bundiya Respondent :- State of U.P. and Another Counsel for Petitioner :- Ravi Sahu Counsel for Respondent :- C.S.C.,Harshit Pandey Hon'ble Ajay Bhanot,J. The petitioner's husband was working as safai karmchari in the Nagar Nigam, Kanpur Nagar. He superannuated after completion of his service and died on 29.08.2010. The petitioner claims that she is entitled to the benefit of Assured Career Progression (A.C.P.), revised pension and its arrears and interest thereof. She has made a representation in this regard but to no avail. The only prayer made by Shri Ravi Sahu, learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Shri Harshit Pandey, learned counsel for the respondent No.2 submits that the matter requires determination of
facts by the competent authority in light of applicable provisions of law in the first instance. However, he fairly contends that the service benefit/claim is liable to be decided by the competent authority in a reasonable time frame. In wake of the aforesaid submissions and without going
into the merits of the case, the respondent no.2 is directed to decide the representation of the petitioner regarding grant of certain entitlements including the benefit of Assured Career Progression (A.C.P.) in accordance with law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. The husband of the petitioner died on 29.08.2010 and the petitioner approached this Court in May, 2025. In view of the admitted delay on the part of the petitioner without any good cause in approaching the Court no interest shall be admissible for the aforesaid period. The writ petition is finally disposed of.
