The petitioner has been made accused in connection with Poraiyahat P.S. Case No. 41 of 2024, S.T. Case No.342 of 2024, for the offences registered under Sections 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of learned Additional Sessions Judge-II, Giridih. On 04.04.2024 between 06:15 p.m to 06:25 p.m., the informant alongwith his father and cousin brother had gone to Panchmukhi Mandir, Poraiyahat for purchasing sweets. In the meantime, named accused persons came there and fired at the informant party, due to which, father of the informant sustained injury and succumbed to his injuries. It was submitted that petitioner is not named in the F.I.R. It was further submitted that there is no specific allegation against the petitioner and his name has transpired in the confession of co-accused. It was also submitted that similarly situated co-accused Lokesh Kumar and Abhinav Kumar have been granted bail by this Court earlier. Mrs. Anuradha Sahay, learned A.P.P on behalf of the State has opposed the prayer for bail. In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II, Giridih, in connection with Poraiyahat P.S. Case No. 41 of 2024, S.T. Case No.342 of 2024. (Ambuj Nath, J.) BS/-
