Dr. Kirti Parmar vs. State of H.P. and others
CWP No. 1206 of 2025
16.01.2025 Present: Mr. K.B. Khajuria, Advocate, for the petitioner.
Mr. Rajan Kahol and Mr. Bhagwati Chander Verma, Additional Advocates General, for respondents No.1 to 3/State.
Mr. Balram Sharma, DSGI with Mr. Rajeev Sharma, Advocate, for respondent No.4
CWP No. 1206 of 2025 & CMP No. 1668 of 2025
Notice. Mr. Rajan Kahol, learned Additional Advocate General and Mr. Rajeev Sharma, Advocate, appear and waive service of notice on behalf of respondents No. 1 to 3 and respondent No.4, respectively.
Reliance has been placed upon the Letters Patent Appeal No.450 of 2024 titled as Ajay Kumar Chauhan vs. State of H.P. and ors., directed against the denial of NOC by the learned Single Judge. The denial of NOC, prima facie, to seek better prospects by appellant cannot, in my considered, view, be a valid ground, as such, for the State. Accordingly, I direct that the provisional NOC be granted to the appellant, by the State, on or before 21.01.2025.
Though the learned Additional Advocate General submits that the State is facing acute shortage of Doctors, I am of the considered opinion that it is always open for the State to fill up the posts on regular basis by issuing necessary advertisements, time and again and the persons
recruited, as such, serving the State without any commitment or contract to the contrary cannot be fettered, as such, to seek better job prospects.
List on 27.03.2025.
