This is the Fourth Bail Application filed under Section 483 of the BNSS, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 49/2024 registered at Police Station - Keregaon, District- Dhamtari, (C.G.), for the offence punishable under Section 20(b) of Narcotic Drugs and Psychotropic Substances Act. 2. The earlier bail applications of the applicant being MCRC Nos. 6230/2024, 8791/2024 and 3528/2025 were rejected by this Court vide orders dated 06.09.2024, 16.12.2024 and 07.05.2025 RAHUL DEWANGAN Digitally signed by RAHUL DEWANGAN 2 respectively on the ground that the applicant has one criminal antecedent under the similar nature which is pending. 3. Case of the prosecution, in brief, is that the Police of Police Station Keregaon, District- Dhamtari (C.G.), had received secret information from the informant and on the basis of the said information conducted a raid and seized the contraband article i.e. 1.070 kg of Ganja from the joint possession of the present applicant and other co-accused persons. Thereafter, the Police has registered the offence punishable under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985 against the present applicant and other co-accused persons. 4. Learned counsel for the applicant submits that, the earlier bail applications of the applicant was rejected by this Court on the ground that the applicant has one criminal antecedent under the similar nature which is pending with a direction to conclude the trial expeditiously and the applicant is in jail since 19.07.2024. He further submits that as per the status of the trial, out of 16 prosecution witnesses, only 06 witnesses have been examined in the case. Hence, he prays for grant of bail to the applicant. 5. On the other hand, learned State counsel opposes the bail application of the present applicant. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. Taking into consideration the facts and circumstances of the case and also considering the fact that this is the fourth bail application 3 and the earlier bail applications of the applicant were rejected on the ground that the applicant has one criminal antecedent under the similar nature which is still pending, and as per the status of the trial, out of 16 prosecution witnesses, only 06 witnesses have been examined in the case, the same cannot be a ground for releasing the applicant on bail. Hence, this fourth bail application of the present applicant is rejected. 8. Accordingly, the third bail application of applicant – Sayyed Sahil involved in Crime No. 49/2024 registered at Police Station - Keregaon, District- Dhamtari, (C.G.), for the offence punishable under Section 20(b) of Narcotic Drugs and Psychotropic Substances Act, is rejected. 9. However, this Court hopes and trusts that the trial Court shall make an earnest endeavour to conclude the trial as expeditiously as possible within a period of four months from the receipt of a certified copy of this order in accordance with law, if there is no legal impediment. 10.
