2 Hon’ble Shri Justice Parth Prateem Sahu
Order On Board 11-12-2025 1) By way of this petition, petitioner has sought following relief(s):- (i) That, this Hon'ble Court may kindly be pleased to direct the Respondent No. 2 to take action/steps against the Respondent No. 6 Colonizer and to ensure that all the development work is completed by the colonizer in the kalindi Kunj Colony, in the interest of justice. (ii) That, this Hon'ble court be pleased to direct the Respondent No. 6 to complete all the development work of the colony in the time bound manner, in the interest of justice. (iii) Any other relief which this Hon'ble Court may deem fit be granted. 2) Learned counsel for the petitioner submits that petitioner is a society registered under the provisions of Chhattisgarh Cooperative Societies Act, 1960 and its members are residents of Kalindi Kunj Colony, Bilaspur which was developed by respondents No. 6 and 7 herein, after taking permission from the authorities including respondent No. 2 Municipal Corporation. He further submits that respondents No. 6 and 7 have sold all the plots of the colony but the colony lacks a boundary wall and other basic amenities which were earlier promised by the developers. He contends that one of the nearby land owner is trying to encroach upon the land of colony which was left open for the welfare of residents of the colony. He argues that in this regard, petitioner-society made several representations before
3 respondent No. 2 but till date, no action has been taken. He prays that direction may be issued to consider the pending representations at the earliest. 3) On the other hand, learned State counsel submits that main grievance of the petitioner-society is with respondent No. 2. 4) Learned counsel appearing for respondent No. 2 submits that as petitioner is not pressing the writ petition on merits, rather seeking direction to decide the pending representations, to which he is having no objection to limited prayer. He further submits that if any representation remains pending, same will be decided at the earliest, strictly in accordance with the law. 5) Heard learned counsel for the parties and perused the documents placed on record. 6) Taking into consideration the submissions made herein-above and the limited prayer made in the petition, instant petition is hereby
disposed of directing Commissioner, Municipal Corporation i.e. respondent No. 2 to decide the pending representations dated 25.11.2024, 7.9.2024, 12.3.2025, 24.3.2025 and 4.4.2025 (Annexure P/9 collectively) so moved by the petitioner-society in accordance with law, preferably within period of two months from the date of receipt of copy of this order. 7) Accordingly, instant writ petition stands disposed of.
