This suit is filed on behalf of the Plaintiff inter alia seeking a decree of permanent injunction restraining Defendant No. 3 and all others acting on its behalf from using, copying, publishing, distributing, transmitting, communicating and/or disclosing to any person, by any means whatsoever This is a digitally signed order. During the pendency of the suit, concerned parties have agreed for passing the following directions and in light thereof, for disposal of the suit:- (A) Plaintiff shall be at liberty to approach Defendant Nos. 13, 15 to 18 and 20, copying their respective counsels on record with the relevant details of any subsequently discovered URLs, accounts, groups, email addresses and/or content, as applicable, relating to the subject matter of the present suit and containing, using, copying, publishing, distributing, transmitting, communicating or otherwise disclosing or attempting or threatening to do any of the above, in respect of the confidential information or personal sensitive data belonging to the Plaintiff or its customers, as identified in paragraph 23 of the plaint. Plaintiff shall provide the concerned Defendant with supporting particulars/documents demonstrating that such URLs, accounts, groups, email addresses and/or content, as applicable, form the subject matter of the present suit, on an affidavit. Upon receiving such request with details of relevant URL(s), account, group(s) and/or content, as applicable, the concerned Defendant shall independently examine and evaluate Plaintiff’s request and act in terms of their respective policies. Concerned Defendant(s) shall acknowledge the request within 24 hours and take action within 36 hours thereafter. In case the concerned Defendant(s) does not act upon This is a digitally signed order. (B) It is further directed that, in case the concerned Defendant(s) in paragraph (A) above, takes action to take down the relevant URL(s), account, group, email address and/or content, as applicable, then such Defendant shall forthwith preserve and retain all information and records available with or accessible to the concerned Defendant in relation to such account, URL, group, email address and/or content, including the account- holder’s/subscriber’s name and address, email address, contact details, account or profile URL or identifier, IP address(es) from which the account was accessed, access/login details and timestamps as also location history, as applicable, in terms of the governing law. Plaintiff shall be at liberty to seek disclosure of the preserved and retained information from the concerned authority and/or through Court, after following due process in this regard. (C) With respect to Defendant No. 19/WhatsApp, in the event any fresh WhatsApp account/number is subsequently identified by the Plaintiff, which is used for the same subject matter as the present suit, including for using, copying, publishing, distributing, transmitting, communicating, disclosing or attempting or threatening to disclose any information or data belonging to the Plaintiff or its customers, as identified in paragraph 23 of the plaint, Plaintiff shall be at liberty to approach the Court by filing appropriate application in this suit for This is a digitally signed order.
