ORDER Date : 14-02-2025 Heard Mr. N Sarma, learned counsel for the petitioner, who submits that the petitioner responded to an advertisement dated 09.12.2024, which was advertised for the post of Anganwadi Helper in Salmorabari Khalkata Bilpar and the last date of submission of such application was 23.12.2024 till 3:00 pm. As the petitioner has submitted all the requisite materials, she and two other persons were found to be eligible to be considered for the said post, while the respondent No. 5 was amongst the rejected candidates for the post for having not attached her H.S.L.C. mark sheet and certificate in her application. However, to the surprise of the petitioner, the respondent No. 5 has been allowed to participate in the selection process as per a purported decision taken by the Selection Board. Aggrieved with the same, the petitioner submitted a representation to the Director, Women and Child Welfare Department, Government of Assam on 06.01.2025 stating that the action of the Selection Board was in clear violation of the terms and conditions stipulated in the advertisement. Since the representation of the petitioner has not been considered, the petitioner is before this Court. Page No.# 3/3 [2.] A perusal of the terms and conditions of the advertisement at Sl. No. 11 would go to show that the candidates are required to submit their self attested copy of Aadhaar card, educational qualification (including list of marks), birth certificate (High School Leaving Certificate or other valid documents), etc. Clause (g) under the heading “Application forms will be rejected immediately if the candidate” provides that such application submitted by the candidates will be rejected if they do not provide all the information required in the form. [3.] Having regard to the grievance projected by the petitioner and the terms and conditions stipulated in the advertisement and importantly the pending representation of the petitioner, this Court is of the considered view that the grievance of the petitioner should be addressed by the respondent authority concerned, which has been projected in the representation dated
06.01.2025. [4.] Accordingly, the writ petition is disposed of with a direction to the Director, Women and Child Welfare Department, Government of Assam (respondent No. 2) to consider the representation of the petitioner and pass a reasoned and speaking order within a period of one month from the date of receipt of a certified copy of this order.
It is also provided herein that till such
order is passed by the respondent No. 2, selection to the post of Anganwadi Helper in the Anganwadi Centre concerned shall not be finalised.
