JUSTICE R.K. PATTANAIK Order No. ORDER 15.01.2025 06. 1. Heard learned counsel for the petitioner and State. 2. Instant petition is filed for release of the petitioner on bail in connection with G.R. Case No. 939 of 2023 corresponding to Malkangiri P.S. Case No. 760 of 2023 pending in the file of learned S.D.J.M., Malkangiri on the grounds stated therein. 3. Learned counsel for the petitioner submits that the two other petitioners are on bail by the Court’s order in BLAPL No.11876 and 11881 of 2024 including the accused for similar offences and hence, he should be released in the present case as well with similar conditions. 4. Mr. Sahoo, learned AGA for the State opposed release of the petitioner on bail since he has many criminal antecedents. 5. The copies of the orders in BLAPL No. 11876 and 11881 of 2024 are produced for the Court’s perusal. 6. The allegation which is revealed from Annexure-2, such as, the rejection order is that the petitioner received an amount of Rs.4.5 lac to provide job to the informant, who has at last been cheated. Having regard to the above facts and submissions of learned counsel for the petitioner and as the petitioner, a local resident though involved in similar other cases but is on bail by the Court’s order in BLAPL Nos.11876 and 11881 of 2024 corresponding to G.R. Case No.479 and 480 of 2024, the Court is inclined to release him bail on subject to conditions. 7. Accordingly, it is ordered. 8. In the result, the petition stands allowed. Consequently, the petitioner is directed to be released on bail in connection with G.R. Case No. 939 of 2023 corresponding to Malkangiri P.S. Case No. 760 of 2023 subject to him furnishing a bail bond of Rs.40,000/- (rupees forty thousand) with one solvent surety for the like amount to the satisfaction of the learned S.D.J.M., Malkangiri, who shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides to deposit a cash security of Rs.1 lac. in the court below to be kept in a fixed deposit in any nationalized bank for a period of six months, disbursement of which, would be on the orders of the court below. 9.
