The applicant has preferred this First Bail Application under Section 483 of BNSS, 2023 for grant of regular bail, as he has 2 been arrested in connection with Crime No. 353/2025, registered at Police Station Sarangarh, District- Sarangarh-Bilaigarh (CG) for the offence punishable under Section 103(1), 3(5) of BNS, 2023. 2. The prosecution story in brief, is that, the applicant along with the co-accusd committed murder of the deceased by strangulating her with a plastic ropes and by pressing her mouth with a pillow. The incident took place after a dispute arose when the co- accused said that deceased has taken Ertiga Car then the present applicant strangled the deceased with a nylon rope. 3. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. There is no eye-witness in the present case, no CCTV footage has been seized by the prosecution. The prosecution has not proved that the present applicant has made strangulation. The applicant is in jail since 20.07.2025 and conclusion of the trial will take some time. Therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and submits that all the evidences are against the applicant. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy, prima 3 facie shows that the medical report of the deceased reveals that the nature of the death is homicidal and mode of death is Cardiorespiratory arrest that is Asphyxia due to ligature strangulation and its complication, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. Accordingly, the bail application of applicant- Amit Kumar Kurre involved in Crime No. 353/2025 under Sections 103(1), 3(5) of BNS, 2023 at Police Station- Sarangarh, District- Sarangarh- Bilaigarh, Chhattisgarh, is rejected. 7. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible in accordance with law, if there is no legal impediment. 8.
