Learned counsel for the petitioners submits that the present petition has been filed against the order dated 27.02.2024 passed in Title (Partition) Suit No. 27 of 2017 by learned Sub-Judge I, Naugachia, Bhagalpur, whereby and whereunder the learned trial court rejected the application of the petitioners filed under Order 7 Rule 11 of the Code of Civil Procedure. Learned counsel further submits that against such Patna High Court C.Misc. No.833 of 2024(2) dt.05-02-2025 2/2 order, civil revision would lie and civil miscellaneous is not maintainable. Learned counsel seeks permission to convert the present petition into civil revision. 3. Permission is accorded. 4.
