The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of regular bail, as he has been arrested in connection with Crime No. 45/2025, registered at Police Station Kotwali, Raipur, District – Raipur (CG) for the offence punishable under Sections 317(2), 317(4), 317(5) and 111 of BNS. 2. The prosecution story in brief, is that based on investigation regarding government letter for who use mule account of different bank for transactions of illegal money to legal money from 01.01.2024 to 11.01.2025 on which present account was also identified with other accounts of co-accused to register the name, on the basis of the information report was lodged against the present applicant. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. It is further submitted that the applicant happens to be a lady and the applicant blindly faith in her boyfriend but co-accused Rahul Yadav deceit to present applicant and he made her account and used it and after some time her boyfriend sold account to another person is not aware about preparation of account not about selling of account. The applicant is in jail since 13.05.2025 and the trial is likely to take some time for its conclusion. Therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State counsel opposes the bail application and submits that the charge-sheet has been filed in the present case before the competent Court. It is submitted that the regular bail application of the co-accused persons including lady accused have already been rejected by this Court vide order dated 16.07.2025, 08.09.2025 and 15.10.2025 passed in MCRC Nos. 5560/2025, 7151/2025 and 8270/2025, and the anticipatory bail application of the co-accused has also been rejected by this Court vide order dated 21.07.2025 passed in MCRCA No.1064/2025, therefore, the applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy and the fact that the applicant’s role has come into light that she along with the co-accused persons are involved in a crime of cyber fraud with respect to the mule accounts, and though the applicant happens to be a lady, but the 3 regular bail application of the co-accused persons including lady accused have already been rejected by this Court vide order dated 16.07.2025, 08.09.2025 and 15.10.2025 passed in MCRC Nos. 5560/2025, 7151/2025 and 8270/2025, and the anticipatory bail application of the co-accused has also been rejected by this Court vide order dated 21.07.2025 passed in MCRCA No.1064/2025, hence, this Court is of the opinion that is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant- Kajal Yadav, involved in Crime No. 45/2025, registered at Police Station Kotwali, Raipur, District – Raipur (CG) for the offence punishable under Sections 317(2), 317(4), 317(5) and 111 of BNS, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and concluded the trial expeditiously. 9.
