This first anticipatory bail application under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.570/2025 registered at Police Station- City Kotwali, Raigarh, District – Raigarh (C.G.) for the offences punishable under Sections 196 and 299 of the BNS. Prosecution case in brief is that it is alleged that on 30/10/2025, the applicant posted a post in his social media which is taken as derogatory against ChhatthParv, based upon such, first information report has lodged in police station City Kotwali, Raigarh, District Raigarh wherein the crime number 570/2025 registered against the applicant. 3. Learned counsel for the applicant submits that the present applicant has been falsely implicated in this case, as he has no connection whatsoever with the alleged offences. It is submitted that the applicant is a journalist by profession and has not posted any derogatory or offensive remarks against Chhath Parv or any community, rather, he had merely shared a general post related to the festival. It is further contended that the allegations levelled against him are false and motivated by personal animosity and the applicant has been made a scapegoat despite having no criminal intent or involvement in the alleged acts. He further submits that the applicant is the sole earning member of his family and is also suffering from certain physical ailments. It is urged that there is no material on record to prima facie connect the applicant with the offences in question, hence he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel has opposed the prayer for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 3 6. Considering the facts & circumstances of the case, submissions of learned counsel for the parties and nature of dispute and material available in case diary, without further commenting anything on merits, this Court find it appropriate to grant anticipatory bail to the applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Chandrakant Sharma alias Tillu Sharma, on executing a personal bond with one surety in the like sum to the satisfaction of the arresting OfÏcer, he shall be released on bail on the following conditions:- (a) He shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) He shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) He shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
