ORDER 07.08.2025
Order No.
03. 1. This matter is taken up through hybrid mode. 2. Petitioner in this writ petition prays for a direction to the Land Acquisition Officer, Angul – Opposite Party No.4 to release the compensation amount of Rs.10,26,356.00/- (Rupees Ten lakhs Twenty-Six thousand Three hundred Fifty-Six only) awarded in favour of her late husband Bibhuti Bhusana Singh for acquisition of his land. 3. Ms. Rajalaxmi Biswal, learned counsel for the Petitioner submits that for acquisition of land of her late husband namely Bibhuti Bhusana Singh, he was awarded with Rs.10,26,356/- as compensation and a notice was issued to him on 23rd August, 2012 (Annexure-3) to receive the said amount. It is alleged that although
the husband of the Petitioner had approached the Land Acquisition Officer, Angul for release of the amount, but the same was not entertained. When the matter stood thus, said Bibhuti Bhusana Singh died on 22nd July, 2021. Copy of his death certificate has been annexed to the writ petition. Thereafter, the Petitioner is also approaching the Authority for release of the amount. Having failed in all her attempts to receive the compensation amount, this writ petition has been filed. 4. Mr. Sibanarayan Biswal, learned Additional Standing Counsel referring to the affidavit filed by Opposite Party Nos. 1 to 4 submits that Bibhuti Bhusana Singh was the father of the Petitioner. His land pertaining to Holding No.1078, Plot Nos. 601 and 603 to an extent of Ac. 0.2965 was acquired and he was awarded a compensation of Rs.10,26,356/- vide Award No. 2056 under Section 11 of the Land Acquisition Act, 1894 (for brevity of the Act). For disbursement of the awarded amount, notice under Section 12(2) of the Act was issued to said Bibhuti Bhusana Singh on 23rd August, 2012. But neither he turned up to receive the said compensation nor he filed any written complaint before the Land Acquisition Officer questioning the adequacy of compensation or otherwise. As the said compensation was not received by Bibhuti Bhusana Singh, it is lying with the Land Acquisition Officer (G), Angul. It is his submission that if the Petitioner approaches the Land Acquisition Officer (G), Angul to receive the said amount along with proof of her entitlement, she will be disbursed with the said amount. 5.
Taking into consideration the submission made by learned counsel for the parties, this Court directs that if the Petitioner appears before the Land Acquisition Officer (G), Angul on 1st
September, 2025 along with the legal heir certificate of late Sri Bibhuti Bhusana Singh, who was the recorded tenant of the acquired land, the said amount shall be released in her favour forthwith as per her entitlement. 6. The Writ Petition is accordingly disposed of. Urgent certified copy of this order be granted on proper application. (K.R. Mohapatra)
