1. The petitioners are before this Court seeking the following prayer: a. To direct the Respondents by way of writ of mandamus to consider the demand made by petitioners as per the notice dated 27.08.2020 and to take suitable steps to implement the demand of petitioners in accordance with law. b. Pass such other orders as this Hon’ble Court deems fit under the facts and circumstances of the case including the award of costs in the interest of justice and equity. 2. The petitioners allege through a legal notice caused that the State in the Forest Department is forming a road in Survey No.48 from Ramanatheshwara Temple to Sirsi on the

Sirsi-Yellapur State Highway. According to the petitioners this was contrary to law. The mandamus is sought to consider the demand made by the petitioner in the notice dated 27.08.2020.
While a writ of mandamus cannot be issued to direct consideration of a legal notice that is caused upon the respondent, the legal notice has to be replied or otherwise. 3. Be that as it may, the formation of road is what was alleged that was taking place in the year 2020. Five years down, the line the position is not indicated as on today. Therefore, the petition is disposed reserving liberty to the petitioner to avail of such remedy as available in law. Ordered accordingly. Sd/- (M.NAGAPRASANNA) JUDGE
