The Court made the following order:
The present writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
“…to issue a writ of Mandamus or any other appropriate writ
order or direction declaring the action of the 2nd respondent not restoring the petitioner fair price shop No.0717066 of Venkatapuram Village, Guttikonda Post, Piduguralla Mandal, Guntur now Palanadu District is illegal, arbitrary and violation of principles of natural justice and consequently, direct the 2nd respondent to forthwith to restore the authorization of the petitioner fair price shop No.0717066 of Venkatapuram Village, Guttikonda Post, Piduguralla Mandal, Guntur now Palanadu District and pass such other orders as deem fit and proper in the facts and circumstances of the case.”
2. It is the case of the petitioner that he is a dealer of Fair Price Shop No.0717066 of Venkatapuram Village, Guttikonda Post,
2 Piduguralla Mandal, Guntur now Palnadu District. Due to change in the political scenario and under the influence of the third parties and with an intention to grab the dealership of the petitioner, the respondent authorities forcefully obtained letter to grant leave for six months.

Learned counsel for the petitioner submits that the petitioner had made several representations for reinstatement of his Fair Price Shop dealership and stated that the content in leave letter was obtained under threat. The petitioner further states that he has paid the requisite fee on 22.02.2024 for renewal of his authorization. The respondents without considering his renewal for authorization, has appointed another person from DWCRA group. Hence the present Writ Petition is filed seeking restoration of authorization of FPS dealership of the petitioner.

On the other hand, learned Government Pleader opposed the same and submitted that since the petitioner has failed collect the essential commodities, the respondents have made temporary arrangement and further submits that the petitioner was not available at his shop to serve notice, dated 08.01.2025, issued by the 2nd respondent/Revenue Divisional Officer and the copy of the said notice was served to the counsel across the Bench today.
5. Upon receiving the notice, learned counsel for the petitioner has requested time to submit explanation to the notice dated 08.01.2025 and to afford opportunity of personal hearing.

As the learned counsel for the petitioner requested time to submit explanation to the notice, dated 08.01.2025, this Court is inclined to dispose of this writ petition at the admission stage by directing the petitioner to submit his explanation to the notice, dated 08.01.2025, issued by the 2nd respondent within a period of one (1) week from the date of receipt of a copy of this order and on receipt of such explanation, the respondent authorities shall consider the explanation submitted by the petitioner and pass appropriate reasoned
order, in accordance with law, within a period of two (2) weeks thereafter.
7. With the above said observation, the Writ Petition is disposed of. There shall be no order as to costs.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
