HIGH COURT OF UTTARAKHAND AT NAINITAL Second Bail Application No.101 of 2025 Kurban Ali ….....Applicant Versus State of Uttarakhand ….….Respondent Present:- Mr. Mohd. Safdar and Mr. Bilal Ahmed, Advocates for the applicant. Mr. Vijay Khanduri, Brief Holder for the State. Hon’ble Ravindra Maithani, J. (Oral) Applicant is in judicial custody in Case Crime No.382 of 2022, under Sections 420, 467, 468, 471, 120-B IPC, Police Station Kotwali Roorkee, District Haridwar. He has sought his release on bail. 2. Heard learned counsel for the parties and perused. 3. This is the second bail application. The first bail application, being BA1 No.1600 of 2024, was dismissed as withdrawn on 17.12.2024. 4. Learned counsel for the applicant submits that co-accused Anees, who is the buyer and Christopher, who is witness of the sale deed, have already been granted bail; it is a case of sale by impersonation; the informant has already compromised the matter and the civil suit has also been 2 decided on that basis. In addition to it, it is also argued that in the instant case, the grounds of arrest has not been communicated to the applicant in writing. 5. These facts are not disputed by learned State Counsel. 6. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 8. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
