GP FOR REVENUE The Court made the following: THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION No.2973 of 2025 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “….to issue a Writ or order or orders or direction more particularly one in the nature of writ of mandamus declaring the action of the 4th respondent in not taking any action on the representation of the petitioner dt.24.01.2023 in implementing the orders of the 3rd respondent dt.12.07.2012 in D.Dis.No.878/2012 (S.D.T) with regard to giving possession of the property in an extent of Ac.05.00 cents situated in R.S.No.676/10 of Kalavapudi Village, Kalla Mandal, West Godavari District by following the procedure contemplated under AP Assigned Lands (Prohibitions of Transfers) Act, 1977 as amended by the Act 8 of 2007 as illegal, arbitrary, unjust, discriminatory and also in violation of principles of natural justice apart from violation of Article 300-A of constitution of India and consequently direct the 4th respondent to implement the order dt.12.07.2012 of the 3rd respondent in accordance with law and pass such other order or orders …..” 2. Heard learned counsel for the petitioner and learned Government Pleader for Revenue for the respondents. 3. Learned counsel for the petitioner submits that it will be suffice if a direction is given to respondent authorities to consider the representation dated 24.01.2023 submitted by the petitioner requesting to implement the orders of the 3rd respondent dated 12.07.2012 passed in D.Dis.No.878/2012 (S.D.T) with regard to giving of possession of the property admeasuring to an extent of Ac.05.00 cents situated in R.S.No.766/10 of Kalavapudi Village, Kalla Mandal, West Godavari District by following the procedure as contemplated under AP Assigned Lands (Prohibition of Transfers) Act, 1977. 4. Learned Government Pleader appearing for the respondents would submit that the representation dated 24.01.2023 submitted by the petitioner would be considered by the respondent authorities in accordance with law, within a reasonable time. 5. Having regard to the submissions made by learned counsel for the petitioner and learned Government Pleader for the respondents, in view of the facts and circumstances of the case, without touching merits of the case, this Court is of the considered view that the present Writ Petition can be disposed of, directing the respondent authorities to consider the representation dated 24.01.2023 submitted by the petitioner and pass appropriate orders, after providing an opportunity of hearing to the petitioner, within a period of three (03) months from the date of receipt of a copy of this order. 6. With the above said direction, the Writ Petition is disposed of. There shall be no order as to costs.
