At the very outset, Shri Ravi Shanker Pandey, learned ACSC raises a preliminary objection with regard to maintainability of the writ petition on the ground that against the impugned order passed by the Commercial Tax Tribunal, the petitioner has equally, efficacious alternative remedy of filing a revision. Confronted with the said fact, learned counsel for the petitioner prays for withdrawal of the present writ petition, with liberty to file a revision. Accordingly, the writ petition is dismissed as withdrawn. Certified copy, if any, may be returned to the counsel for the petitioner after retaining its photostat copy.
