ANIMA M., GOVERNMENT PLEADER THIS WRIT PETITION (CIVIL) HAVING COME UP FOR ADMISSION ON 27.03.2025, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING: 2025:KER:26175 WP(C) No.12599 of 2025 3 JUDGMENT Dated this the 27th day of March, 2025 The petitioner submits that she is presently working as a High School Teacher (Hindi) in SVGV Higher Secondary School, Kidangannoor as per Ext.P2 appointment order. She has entered Aided School service as Lower Grade Hindi Teacher with effect from 25.06.2012 as per Ext.P1 appointment order. 2. In Ext.P6 revisional order, approval for the petitioner’s promotion and appointment as High School Teacher (Hindi) has been rejected on the ground that she did not possess K-TET category No.III qualification and no Government Order was issued granting any exemption. The petitioner states that by Ext.P7 Government Order, the 1st respondent has granted exemption to Aided School Teachers, who have entered Aided School service with effect from 01.06.2012 onwards from acquiring the requisite K-TET 2025:KER:26175 WP(C) No.12599 of 2025 4 qualification and by Ext.P8 order the 2nd respondent has directed all Educational Authorities to reconsider the appointments rejected on the basis of lack of K-TET qualifications without there being any appellate or revisional order. 3. It was in these circumstances that the petitioner has submitted Ext.P9 before the 4th respondent and the same is pending. Therefore, this Court may direct the 4th respondent to grant the benefit of Exts.P7 and P8 to the petitioner forthwith or within such time as this Court may deem fit and proper in the interest of justice, contends the petitioner. 4. I have heard the learned counsel for the petitioner and the learned Government Pleader representing respondents 1 to 4. 5. The petitioner would submit that as per Ext.P7 Government Order, she is entitled to the benefit of exemption as the petitioner had entered Aided School service as LG Hindi Teacher in the year 2012. Ext.P8 endorsement 2025:KER:26175 WP(C) No.12599 of 2025 5 made by the 2nd respondent is unsustainable. The Educational Authority has to reconsider the rejection of approval and grant the same in the light of the exemption order. 6. Be that as it may, I find that the petitioner has preferred Ext.P9 representation in this regard before the 4th respondent-District Educational Officer. In the facts of the case, it would be sufficient if the 4th respondent considers Ext.P9 and passes appropriate orders thereon in accordance with law. The writ petition is therefore disposed of directing the 4th respondent-District Educational Officer to consider Ext.P9 representation and pass appropriate orders thereon within a period of four weeks, after granting opportunity of hearing to the petitioner.
