1. Heard Mr. I. Alam, the learned counsel for the petitioner. Also heard, Mr. K. Baishya, learned Additional Public Prosecutor for the State respondent as well as Mr. M. Chetia, the learned counsel for the respondent No. 2.
2. The learned counsel for the petitioner submits that in this case, the petitioner has prayed for quashing of the FIR dated 10.10.2023 filed by the respondent No. 2 on the basis of which Lakhipur P. S. Case No. 274/2023 was registered.
3. However, the learned counsel for the petitioner further submits that in the meanwhile the charge-sheet as already been laid and the petitioner intends to challenge the charge-sheet also.
4. Hence, he prays for allowing the petitioner to withdraw the Criminal Petition with liberty to file an appropriate application challenging the charge- sheet filed in the Lakhipur P.S Case No. 274/2023.
5. The prayer is allowed.
6. This Criminal Petition is dismissed on withdrawal with the liberty as sought for by the petitioner granted.
