This writ petition has been filed with the following prayer:- "1. to issue a writ order or direction in the nature of mandamus commanding and directing the Respondent No 2 Sub Divisional Offecer, Tehsil Nizamabad, District Azamgarh to decide the Restoration / Recall application No.2393/2025 Computerize case No. T202515060202393 dated 14.03.2018 (Rampyare (Decesed) verses preferred against Ex party order dated 03.10.2017 passed in exchange Case No. 3885/2017 Computerize case No. T201715657023885 dated 24.03.20217 (Baburam Versus Gaon Shabha) Under section 101 Uttar Pradesh Revenue Code 2006. Mauja Ohadpur Pargana Nizamabad Tahsil Nizamabad District Azamgarhand any other writ order or direction as this Hon'ble Court may deem fit and proper in the circumstances of the case." It is contended that Restoration/Recall Application No.2393 of 2025 (Computerized Case No.T202515060202393) is pending in proceedings under Section 101 of the U.P. Revenue Code, 2006 before respondent no.2- Sub Divisional Officer, Tehsil Nizamabad, District- Azamgarh. Learned counsel for the petitioners submits that the said restoration application may be decided expeditiously. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit or issuing notice to private respondent, the matter is being disposed of, at the admission stage, with a direction upon respondent no.2- Sub Divisional Officer, Tehsil Nizamabad, District- Azamgarh to decide the Restoration/Recall Application No.2393 of 2025 (Computerized Case No.T202515060202393) pending in proceedings under Section 101 of the U.P. Revenue Code, 2006, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of two months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
