Heard the learned counsel for the petitioner and the learned counsel for the respondents. 2. The case of the petitioner is that the petitioner filed the writ petition not taking any action against the respondent Nos. 2 to 5 pursuant to the complaint of the petitioner dated 09.02.2019 is under challenging the writ petition. 3. Pending the writ petition, the learned counsel for the 5th respondent filed counter affidavit, wherein it is stated that:- “It is respectfully submitted that prior to my appointment as the panchayat secretary of the Garagaparru Gram panchayat, the construction of the building was over till 90% and the slab was also laid. It is submitted that the pursuant to my appointment, the unofficial respondent has applied for regularization of the building. The request was placed before the panchayat board and the gram panchayat had resolved to regularize the subject building. It is submitted that in view of the resolution, the building permission was subsequently granted to the unofficial respondent herein”. 4. In view of the written instructions issued by the 5th respondent, i.e., the Panchayat Secretary, the grievance of the petitioner has become infructuous. Therefore, no orders are necessary in the writ petition. 5. Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.
