The present Habeas Corpus Writ Petition has been filed with a prayer to issue a writ, order or direction in the nature of Habeas Corpus directing the respondent no.4 to produce the corpus before this Court which is illegally detained by respondent no. 4. It has been submitted by learned counsel for the petitioners that the petitioner no.1 Avishi Prajpati (corpus) is her daughter and has been illegally detained by respondent no.4 Rishi Prajapati (father of the corpus) due to strange relationship between the couple. Considering the aforesaid facts, as the corpus is not illegally detained by the respondent no.4, the petitioner wants to withdraw the present Habeas Corpus Petition and seeks liberty to file appropriate remedy provided under the Guardian and Wards Act. In the view of the above, the present petition is dismissed as withdrawn with the aforesaid liberty.
