THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY ORDER WAS MADE THEREIN AS UNDER: ORAL ORDER (PER: THE HON'BLE MR. JUSTICE SURAJ GOVINDARAJ) 1. Learned AGA accepts notice for respondents No.1 to 4. 2. The petitioner is before this Court seeking for the following reliefs: a. Wherefore, it is most respectfully prayed before the Hon’ble Court to issue Writ of Mandamus by issuing directions to the concerned Respondent No.3 to grant 02 Acres of agricultural land. b. To issue writ of mandamus by issuing directions to the concerned Respondent No.3 to pay the compensation award amount in the interest of justice and equity. c. Issue such other writ or order or directions as this Hon’ble Court may deem fit in the circumstances of the case. 3. This contention is that petitioner’s father was holding agricultural land of 9 acres in Sy.No.35/1 and Sy.No.136/1B Mallalli Village, Hukkeri Taluk, Belagavi - 3 - HC-KAR NC: 2025:KHC-D:10960 WP No. 105344 of 2024 District which came to be used for the setting up of Hidkal dam. The petitioner’s father though was granted 2 acres of land, remaining promise of another 2 acres was not fulfilled, and it is in that background that the petitioner had submitted a representation on 27.06.2017 at Annexure-G, which have not been considered by respondents though there have been several correspondences among the respondents inter se. Hence, the petitioner had also issued a legal notice dated 11.11.2023 which is also not be acted upon. 4. Whenever any representation has been submitted by a citizen to any authority, it is required that the said Representation to be acted upon and necessary orders to be passed, either accepting or rejecting the Representation submitted in accordance with law, needless to say if an order of rejection is passed, the same would have to be accompanied by reasons. Neither having been done, I pass the following; - 4 - HC-KAR NC: 2025:KHC-D:10960 WP No. 105344 of 2024 ORDER i. The writ petition is allowed. ii. A mandamus is issued, directing respondents to consider the representation of the petitioner dated 27.6.2017 at Annexure-G and the legal notice date 11.11.2023 at Annexure-N and pass necessary orders in accordance with law, within a period of eight weeks from the date of receipt of copy of this order.
