Heard Sri Kapil Tyagi, learned counsel for the applicant and Ms. Ifrah Islam, learned State Law Officer and perused the record. 3. Applicant seeks bail in Case Crime No. 439 of 2023, under Sections 376, 420, 504, 506 of I.P.C., Police Station - Beta-2, District - Gautam Buddha Nagar, during the pendency of trial. 4. At the outset, learned counsel for the applicant has stated that he does not have any instructions. 5. This Court had called for a report regarding the status of trial and in compliance thereof, a report has been submitted by the Trial Court concerned on 04.08.2025. As per the said report, the charge has yet not been framed. The cognizance in the instant case was taken up on 01.12.2023 but none of the accused appeared before the court of learned A.C.J.M.-I, Gautam Buddha Nagar since then. The case has yet not been committed for trial. 6. A perusal of order-sheet indicates that the applicant was granted interim bail by the coordinate Bench of this Court vide order dated 30.11.2023 and he has clearly misused the said interim bail granted to him. 7. Under such circumstances, the bail application is rejected. The interim bail granted to the applicant vide order dated 30.11.2023 is hereby cancelled.
