This is the First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicants arrested in connection with Crime No. 292/2025 registered at Police Station – Balod, District – Balod (C.G.) for the offence punishable under Sections 109(1) of the BNS.
2. Case of the prosecution, in brief, is that on 15-07-2025 the applicant has been called to delivered some goods of victim at her matrimonial house at Village - Salhetola. There is some hot words exchanged between them and the applicant assaulted the victim, resulting to that she sustained serious injuries over her navel-area, and admitted to Rajnandgaon Medical college. Learned counsel appearing for the applicants submits that the applicants are innocent and has been falsely implicated in the present case, and the applicant happens to be the husband of the injured and there was some dispute regarding the maintenance between the two. It is submitted that the applicant is in jail since 17.07.2025, and the conclusion of the trial shall take quite long time. Therefore, he prays for grant of bail. 4. On the other hand, learned State counsel, opposes the bail application and submits that, and the applicant is said to have assaulted the injured with knife on his stomach as well as her navel- region and though in the MLC report no nature of injury has been mentioned, but as per the query report, the injuries are stated to be grievous in nature, and as per the medical reports of the injured, the injured has received a stab injury on her stomach umbilicus with a deep cut, and the doctor has opined that the patient could have died if she did not got treatment in time. As such, the bail application deserves to be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case and also considering the fact that the applicant is said to have assaulted the injured with knife on his stomach as well as her navel- region and though in the MLC report no nature of injury has been mentioned, but as per the query report, the injuries are stated to be grievous in nature, and as per the medical reports of the injured, the
3 injured has received a stab injury on her stomach umbilicus with a deep cut, and the doctor has opined that the patient could have died if she did not got treatment in time, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicants on regular bail. 7. Accordingly, this bail application of applicant – Leeladhar Sahu @ Leelu involved in Crime No. 292/2025 registered at Police Station – Balod, District – Balod (C.G.) for the offence punishable under Sections 109(1) of the BNS, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
