2. This application under Section 483 of the BNSS, 2023 has been filed by the petitioner, namely, Imran Hussain, praying for grant of bail in connection with Moirabari

Section 61(2)/319(2)/318(4)/338/336(3)/340(2)/3(5) of BNS, read with Section 66(C )/66(D ) of IT Act.
3. It is submitted by the learned counsel for the petitioner that the petitioner has been languishing in judicial custody for last 61 days, since his arrest on 30.11.2024. He has completed the mandatory period of 60 days in custody but charge-sheet has not yet been submitted. Hence, the petitioner is entitled for default bail.
4. The learned Additional Public Prosecutor, on the other hand, submits that the charge-sheet has not yet been laid.
5. In view of the above, this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner shall be released on furnishing bail bond of Rs. 30,000/- with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Morigaon. The direction for bail is further subject to the conditions that the accused-petitioner: (a) shall not leave the territorial jurisdiction of learned Chief Judicial Magistrate, Morigaon, without prior written permission from him/her; (b) shall not hamper with the investigation and tamper with the evidence of the case; (c) shall not, directly or indirectly, make any inducement, threat or
Page No.# 3/3 promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
6. The bail application is disposed of accordingly.
