JUSTICE PRANJAL DAS Page No.# 3/3 ORDER 06.08.2025 Heard Mr. H. P. Guwala, learned counsel for the applicant. By this interlocutory application, the applicant has prayed for stay/suspend the proceedings in PRC No. 425/2024 pending in the court of learned SDJM, Kaliabor, Nagaon. It is submitted by the learned counsel for the petitioner that charge- sheeted sections are sessions triable and therefore, for the purpose of committal, if the applicants appear they apprehend that they may be remanded to custody. It is also submitted that civil dispute is pending between the parties, the parties are also filing criminal cases against each other. Learned Additional Public Prosecutor submits that the prayer for stay may be taken up for consideration on receipt of the TCR as well as service of notice. In the given facts and circumstances and considering the above submissions of the petitioner, the prayer for stay of the petitioner is allowed. Accordingly, PRC No. 425/2024 pending in the court of learned SDJM, Kaliabor, Nagaon shall remain stayed till returnable date. The interlocutory application stands disposed of.
