1. The Petitioner claims an interest in property bearing No. E-107, Kalkaji, New Delhi, constructed on a leasehold plot measuring 201 sq. yds. According to the Petitioner, the property was originally held by Late Smt. Rupan Devi, wife of Late Shri Mahura Das, and, upon her demise, was mutated in the names of Late Shri P.L. Vasudeva and Late Shri M.L. Sharma on 20th November, 1978. A Lease Deed in respect of the property was thereafter executed on 18th February, 1980 between the President of India, as the Lessor, and Late Shri P.L. Vasudeva and Late Shri M.L. Sharma. 2. It is the Petitioner’s case that Late Shri P.L. Vasudeva and Late Shri M.L. Sharma executed a Partition Deed dated 7th May, 1981, which was This is a digitally signed order. duly registered. Disputes subsequently arose between them, in connection with which Late Shri P.L. Vasudeva instituted a suit for partition and permanent injunction, being CS No. 13/2005, subsequently renumbered as CS No. 279/2008. The suit was dismissed on 5th May, 2012. The appeal preferred by Late Shri P.L. Vasudeva against the said judgment was subsequently dismissed by this Court on 4th August, 2025. 3. The Petitioner, claiming to be one of the legal heirs of Late Shri M.L. Sharma, has approached this Court seeking mutation of his interest in the property. It is averred that the other surviving legal heir of Late Shri M.L. Sharma, namely Smt. Neelam Bhagatji, executed a registered Relinquishment Deed dated 23rd January, 2017 in favour of the Petitioner, relinquishing her rights in respect of the subject property. 4.
The Petitioner has impleaded Respondent No. 2, who is stated to be one of the legal heirs of Late Shri P.L. Vasudeva, as a party to the present petition. However, counsel for the Petitioner, on instructions, clarifies that Respondent No. 2 is not the sole legal heir of Late Shri P.L. Vasudeva and that there are other legal heirs as well. 5. The limited grievance of the Petitioner is with regard to the mutation of the property in the records of Respondent No. 1, which, according to the Petitioner, has not been effected despite his approaching Respondent No. 1 in this regard. Counsel for the Petitioner fairly clarifies, on instructions, that although the prayer clause seeks mutation of a 50% share in favour of the Petitioner, his request is that the mutation be considered jointly in respect of all persons, who may be found entitled to a share in the property, in accordance with law. 6. In view of the limited nature of the relief now sought, this Court does This is a digitally signed order. not consider it necessary to issue notice in the present petition. The interest of Respondent No. 2, as well as that of the other legal heirs of Late Shri P.L. Vasudeva, can adequately be safeguarded by passing appropriate directions. 7. Accordingly, without entering into the merits of the rival claims or expressing any opinion on the title or entitlement of any of the parties, the present petition is disposed of with the following directions: (a) The Petitioner shall, within two weeks from today, submit a representation to Respondent No. 1 setting out the relevant facts and enclosing all documents upon which he relies in support of his claim for mutation.
(b) Upon receipt of the aforesaid representation, Respondent No. 1 shall issue notice to Respondent No. 2 and the other legal heirs of Late Shri P.L. Vasudeva, as well as to any other person whose interest may be affected by the proposed mutation, and afford them an opportunity to submit their objections, if any. Such details shall be furnished by the Petitioner. (c) Respondent No. 1 shall consider the Petitioner’s request, and any objections received pursuant to the notice issued, and pass an appropriate reasoned order thereon, in accordance with law, within four weeks of the completion of the aforesaid exercise. (d) The Petitioner and the other persons claiming an interest in the property shall comply with such procedural requirements and pay such fees or charges as may be lawfully required for the purpose of considering and effecting the mutation. 8. With the above directions, the present petition is disposed of along with pending application(s), if any. 9. title or entitlement of the Petitioner, Respondent No. 2, or any other person claiming an interest in the property.
