Hon'ble Shri Justice Arvind Kumar Verma, Order on Board 12.12.2025 1) By way of instant Petition filed under Section 528 of Bhartiya Nagarik Suraksha Sanhita, the Petitioner who is an accused in Crime No. 1/2021 registered by the Respondent EOW/ACB, Raipur for the offence punishable under s. 7 of the Prevention of Corruption Act, 1988 and he is facing a criminal trial bearing Special Sessions Case (Corruption) No. 01/2021 which is pending before the learned Court of Special Judge (Prevention of Corruption Act) Balrampur, Place- Ramanujganj (CG), the Petitioner has challenged the Order dated 01.01.2024 (ANNEXURE as well as Order dated 18.09.2024 (ΑΝΝΕXURE P/2). 2) At the very outset, it is evident from the record that nearly 14 prosecution witnesses have already been examined before the learned Trial Court and the trial has substantially progressed. 2 petition has lost its efÏcacy, and the petition has consequently rendered infructuous. 3) Accordingly, the present petition stands dismissed as having become infrcutuous. 4) However, the petitioner shall be at liberty to raise his grievances as a defence before the trial Court and the Trial Court consider and decide the grievance in accordance with law on its own merits. 5) This Court has not expressed anything on the merits of the case.
